Terms and conditions of sale
These terms govern the relationship between Elliot Tram (hereinafter Fullscraper) and any company (hereinafter the Client) placing an order on fullscraper.com.
1. Purpose
Fullscraper provides a managed service for extracting and enriching professional data from public sources, delivered as a CSV file, Google Sheets or direct push into the Client's CRM.
2. Order and payment
All orders are placed via the online form. A Stripe payment link is sent by email within 2 business hours. Payment is full and upfront, by card or SEPA transfer. Prices in euros, excluding tax. French VAT 20% applies by default; reverse charge possible for EU companies outside France with a valid intra-community VAT number.
3. Delivery times
- Standard: 7 business days from Stripe confirmation.
- Express 5 days: +20%.
- Express 48h: +40%.
Deadlines run from confirmed payment and from the Client's validation of the filters sent by email.
4. Hit rate guarantee and partial refund
For services including email and/or phone enrichment, Fullscraper guarantees:
- 70% valid emails on enriched rows.
- 40% valid phones on enriched rows.
If the observed rate is lower, an automatic partial refund is made proportional to the gap, on the enrichment portion of the invoice, within 7 business days.
5. Right of withdrawal
These terms being concluded between professionals, the legal right of withdrawal does not apply (art. L221-3 of the French Consumer Code). Orders are firm and final upon Stripe confirmation.
6. Right to refuse and full refund
Fullscraper reserves the right to refuse any order whose purpose contravenes its terms of use, including:
- Collection of personal data without identifiable GDPR legal basis.
- Sources requiring circumvention of security or authentication measures.
- Targets that are manifestly illegal, misleading or contrary to ethics.
In case of refusal after payment, the Client is fully refunded within 5 business days, with no other compensation due on either side. The refusal is notified by email with written justification.
7. Use of delivered data
Delivered data comes from public professional sources, collected under the legal basis of B2B legitimate interest (art. 6.1.f GDPR). The Client becomes data controller upon receipt and commits to:
- Comply with GDPR and include the required information notices in their first contacts.
- Honor any right of opposition exercised by a prospect.
- Not resell or share the file without written authorization.
8. Liability
Fullscraper's liability is limited to the amount of the ordered service. Fullscraper cannot be held responsible for the Client's use of the delivered data, nor for commercial results arising from its exploitation.
9. Intellectual property
The Client has a right of use for the delivered data for its internal needs. Fullscraper retains intellectual property of its scripts, tools and methods.
10. Confidentiality
Information exchanged (criteria, filters, use cases) is confidential and will not be disclosed or used for other clients.
11. Governing law and jurisdiction
These terms are governed by French law. Any dispute not resolved amicably falls under the exclusive jurisdiction of the courts of the publisher's registered office.
